Defendant Scheidt was convicted of first-degree murder and sentenced. On appeal, we affirmed this judgment. People v. Scheidt, 182 Colo. 374, 513 P.2d 446 (1973). This defendant then filed a motion for a new trial based on newly discovered evidence. After lengthy hearing, the trial court denied the motion. On this appeal, the defendant urges that the trial court erroneously denied his motion. We agree with the trial courts ruling and judgment, and therefore affirm. On oral argument, the parties noted that this motion should be regarded as a motion under Crim. P. 35(b). We agree and deem this to be a 35(b) motion.
